Welcome to our website, www.scentandmore.com. These Terms and Conditions of Sale (T&Cs) govern all sales made on our website. By accessing this site and making a purchase, you accept without reservation the conditions described below.

Scent&More is a registered trademark based in Mouans-Sartoux (06), France, under the registration number R.C.S. 931 096 150.

The Client acknowledges having read and accepted these Terms and Conditions of Sale without reservation when validating their order. The terms “Site,” “Client,” and “Product(s)” are defined as follows:

• The term “Site” refers to the website www.scentandmore.com, operated by Scent&More, offering products for creating candles, soaps, diffusers, and cosmetics.
• The term “Client” refers to any individual or legal entity purchasing one or more Products from the Site.
• The term “Product(s)” refers to the items offered for sale on the Site by Scent&More for the creation of candles, soaps, and cosmetics, such as fragrance concentrates, waxes, wicks, or any other accessory.

These Terms and Conditions of Sale aim to define the contractual relationship between Scent&More and the Client, as well as the terms applicable to any purchase made via the Site. Purchasing a product or service through this Site implies the Client’s full acceptance of these Terms and Conditions of Sale. These terms will prevail over any other conditions not explicitly agreed upon by Scent&More. Scent&More reserves the right to modify its Terms and Conditions of Sale at any time. In such cases, the applicable terms will be those in force on the date of the Client’s order. By confirming their order, the Client acknowledges having read and accepted these Terms and Conditions of Sale without reservation.

The Site provides a product page for each Product, detailing its essential characteristics. Before confirming your order, you will have access to all the necessary information. Photos of Products are non-contractual. Prices, descriptions, and colors of Products displayed on the Site are provided for informational purposes and may be adjusted based on supply, economic conditions, or market trends. The choice and purchase of Products are the sole responsibility of the Client. Scent&More shall not be held responsible for the inability to use a purchased product for any reason. Products offered on the Site comply with current French regulations. Scent&More is not liable for non-compliance with the laws of the country where the Products are delivered. Clients are responsible for checking with local authorities regarding the importation or use of Products or services they intend to order.

Prices for our Products are indicated in euros (€) and are exclusive of tax. VAT and other taxes are calculated and added during Checkout, based on the Client’s delivery address. These prices do not include shipping and insurance costs. Scent&More reserves the right to modify prices at any time without prior notice, depending on supply and economic conditions. However, Products will be billed based on the rates in effect at the time of order validation. Products remain the property of Scent&More until full payment of the order is received. Our offers are valid while supplies last.

For sales outside mainland France, the Client acts as the importer. The Client bears sole responsibility for ensuring the Products’ entry into their destination territory, completing all necessary formalities, and covering any applicable taxes, customs duties, or import charges. By placing an order, the Client confirms that they have read and accepted these Terms and Conditions of Sale. Order validation constitutes acceptance of these Terms and Conditions. Data recorded by our Site serves as proof of all transactions conducted between Scent&More and the Client.

Placing an order on the Site implies an obligation to pay. Orders are considered effective once payment is confirmed for bank transfers or validated by banking institutions for card or PayPal payments. To ensure security and prevent fraud, Scent&More may request proof of identity to verify the legitimacy of an order. In such cases, order validation will only be effective after approval of the provided documents. Scent&More reserves the right to cancel or refuse any order from a Client with unresolved disputes regarding a previous order.

By placing an order, the Client accepts the prices and descriptions of the Products available for sale. Acceptance is equivalent to an electronic signature, which holds the same legal value as a handwritten signature. The electronically validated order is considered final and cannot be retracted. Scent&More will confirm order registration via email.

Our Product offers are valid as long as they are visible on the Site and subject to stock availability, except during promotional events indicated on the Site. If a Product becomes unavailable after order confirmation, Scent&More will notify the Client via email or phone. The order will be automatically canceled, and no charges will apply.

All orders must be paid in euros (€) in full and in one installment at the time of the order. Scent&More reserves the right to request proof of the Client’s identity and address to approve the sale. Order acceptance implies the Client’s irrevocable acceptance of these Terms and Conditions of Sale.

Payment by Stripe:
Payment can be made using credit cards bearing the CB, VISA, or MASTERCARD logo. Our partnership with STRIPE ensures secure payments and data confidentiality. The secure SSL protocol protects all data transmitted on the Site.

Payment by PayPal:
Payment can be made via PayPal. To use this method, the Client must have a PayPal account. PayPal’s general terms and conditions apply to such payments.

Scent&More reserves the right to refuse to deliver or honor any order placed by a Client who has not fully or partially paid for a previous order or with whom a payment dispute is ongoing. Scent&More reserves the right to reject any order deemed suspicious or unverifiable.

Most Products offered on the Site are available in our warehouses. If a Product is out of stock, we will contact you to offer an alternative delivery date or an equivalent replacement Product. You also have the option to cancel your order and request a refund.

We deliver worldwide. For all shipments to mainland France and abroad, shipping and handling fees are charged to the client (unless otherwise specified on the website). These fees are displayed based on the information provided by the client regarding the delivery location. Shipping fees are variable and automatically calculated based on the weight of your order, the destination country, and the selected shipping method. For bulky parcels taxed according to the weight/volume ratio by our service providers, we reserve the right to charge an additional fee corresponding to the difference in price indicated at the time of the order.

Shipping times refer to the time required to prepare your order and hand it over to the carrier at our facilities. Delivery times refer to the time taken by the carrier to transport your order from our warehouse to your delivery location.

Unless otherwise agreed, shipping times are provided for informational purposes only. Buyers may not claim a delay as grounds for canceling the sale, refusing the goods, or demanding compensation. As a guideline, orders received before noon (Monday to Friday) are processed the same day and shipped within 24 to 48 hours. Saturdays, Sundays, and public holidays should be added to the initial timeframe.

Delivery times depend on the chosen carrier and the delivery country. They must be added to the shipping times.

Order and delivery tracking is available on the website. In the event of a shipping delay exceeding 48 hours, an email will be sent to inform you of any potential impact on the previously indicated delivery date. If delayed, we will propose a new delivery date via email. In any case, in accordance with legal provisions, for delivery delays exceeding seven days, you have the right to cancel your order within 60 working days. If the product is received after the cancellation, we will refund the product and outbound shipping costs upon receiving the product in its original and complete condition.

All goods delivered are transported at the buyer’s risk, regardless of the sale conditions or shipping method. The risks associated with the merchandise transfer to the buyer upon leaving our facility. In the event of damage or missing items, it is the buyer’s sole responsibility to safeguard their rights with the carrier by filing reservations on the carrier’s delivery slip and confirming them by registered mail with acknowledgment of receipt to the carrier within 48 hours. Damaged parcels must be retained for the carrier to retrieve and potentially assess for reimbursement. In the event of a lost parcel during transit, investigation times may vary by carrier, taking between one and three weeks. If the carrier declares that the parcel was delivered to the client, no refund will be granted.

If a parcel is not collected from a designated pick-up point within the carrier’s specified timeframe and is returned to Scent&More, we will issue store credit or a refund equivalent to the order amount, minus the actual shipping costs (both outbound and return) and an administrative fee of €10 for order processing and preparation.

Without prejudice to any claims against the carrier, the buyer must conduct a quality inspection upon receipt of the goods. Any claims regarding visible defects or non-conformity of delivered Products must be submitted in writing within eight days of receipt. The buyer must provide sufficient justification for the reported defects or anomalies and allow Scent&More to verify these claims. If the buyer uses or implements the disputed product after submitting a claim, Scent&More will not be held responsible for any resulting damages.

No claims will be accepted if our Products are not used according to standard practices for this type of product, within the specified usage timeframe, and in compliance with applicable regulations and legislation.

If the buyer submits a valid claim within the specified timeframe, we commit to replacing or refunding, at our discretion, any merchandise recognized as non-compliant or defective, excluding any additional compensation or damages of any kind.

In accordance with current legislation under Article L121-21 of the Consumer Code and within the framework of distance selling, individual clients have a 14-day withdrawal period starting from the date of receipt of their order. During this time, the client may request a refund in exchange for the return of delivered products (excluding return shipping costs). If the withdrawal period ends on a Saturday, Sunday, or public holiday, it is extended to the next working day. Article L121-21 of the Consumer Code does not apply to professional clients.

All returns must be pre-approved by contacting Scent&More Customer Service via email. Products must be returned in their original packaging and in like-new condition, free of scratches or signs of wear. Returns must include the original packaging, a copy of the purchase invoice, and the Withdrawal Form. All parcels sent to Scent&More must use a tracked postal service (e.g., Colissimo Suivi, Registered Parcel, or Chronopost). In case of disputes, Scent&More will require proof of shipment from the client.

Upon receipt of the returned items, Scent&More Customer Service will assess the condition of the goods. Scent&More reserves the right to refuse any return, refund, or exchange if the above return conditions are not met. If a refund is approved, it will be issued at Scent&More’s discretion via bank transfer or check sent to the billing address of the client who placed the order within 14 days of the refund notification.

Exclusions:
Under Article L121-21-8, the right of withdrawal does not apply to contracts for:

• Services fully executed before the withdrawal period ends, provided execution began with the consumer’s prior express consent and acknowledgment of their withdrawal rights.
• Goods made to the consumer’s specifications or clearly personalized.

You can view and print your invoice by visiting the “My Account” section of the website under “Orders” and clicking on the relevant order number. Invoices are also sent via email upon shipment to the address provided in your order. All regulatory documents are available for download directly from the product page when applicable.

Upon creating an account, clients are automatically enrolled in the Scent&More Loyalty Program. This program allows clients to accumulate loyalty points for each confirmed order.

In the process of online sales, Scent&More ensures that all necessary measures are taken to secure its website and protect the confidentiality of transmitted data. However, Scent&More cannot be held responsible for any direct or indirect damages caused to the user from using the internet, such as data loss, intrusion, viruses, service interruptions, or other unintended issues.

All elements of the Scent&More website, including but not limited to software, visuals, text, and audio, are the exclusive intellectual property of Scent&More. Reproduction, distribution, or use of any such elements, in whole or in part, without prior written authorization from Scent&More, is strictly prohibited.

Reselling Scent&More products under the Scent&More brand without explicit authorization is also prohibited. If unauthorized resale is identified, Scent&More reserves the right to terminate the reseller’s account and revoke associated privileges without prior notice or compensation.

Under French law no. 78-17 of January 6, 1978, on data processing, files, and liberties, clients have the right to access, rectify, oppose, or delete their personal data. Collected information is for internal use only and will not be shared with third parties without prior consent.

By creating an account on the website, clients are automatically subscribed to the Scent&More Newsletter. Clients may unsubscribe at any time by clicking the “unsubscribe” link in the email or contacting Customer Service.

Contractual information is presented in English, and the Products offered comply with French regulations. For clients outside mainland France, it is their responsibility to ensure the Product’s compliance with local laws. Scent&More cannot be held responsible for non-compliance with foreign regulations.

These General Terms and Conditions of Sale are governed by French law. Any disputes concerning the formation, execution, or termination of the contract between Scent&More and the client will be subject to the exclusive jurisdiction of French courts unless resolved amicably.
